Apprenticeship Levy Funding Rules

Apprenticeship Levy Funding Rules

Updated over a week ago

Overview

The apprenticeship system in England is governed by specific regulations and standards to ensure the quality, fairness, and effectiveness of apprenticeship programmes. Apprenticeship programme managers need to be aware of various compliance requirements relevant to apprenticeships. This article outlines some of the key compliance aspects to help apprenticeship programme managers support their apprentices effectively.

Work Location Requirements

Where does the apprentice need to work?

  • An apprentice must spend at least 50% of their time working in England to be eligible for levy funding.

  • An apprentice may complete part of their apprenticeship abroad if they remain on UK PAYE (Pay As You Earn) and their time spent working abroad does not exceed 50% of the total duration of the apprenticeship.

  • It is not possible for an apprentice to continue their apprenticeship when moving abroad permanently.

Employment Contract Requirements

Can apprentices with a fixed-term contract start an apprenticeship?

  • Apprentices must have a contract duration that covers the full duration of their programme up to the End-Point Assessment.

  • If their current contract does not cover the full duration, their employer must provide a signed declaration that they will extend the contract to meet the length of the programme.

Multiple Apprenticeships

Can an apprentice do two apprenticeships simultaneously?

  • No, an apprentice cannot be enrolled in two apprenticeships at the same time.

  • An apprentice can begin a second apprenticeship (provided they are eligible) at any point after they have completed their End-Point Assessment of their first apprenticeship. This includes passing the assessment or failing it with no plans to resit.
